By creating an account or using Azulyo ("the Service"), you agree to these Terms of Service. If you do not agree, do not use the Service.
These terms form a binding agreement between you ("the Business" or "you") and Azulyo ("we", "us", "our"), a company based in British Columbia, Canada.
Azulyo provides AI-powered phone answering, appointment booking automation, SMS messaging automation, and related tools for appointment-based businesses. The Service includes:
Free trial: New accounts receive a 14-day free trial. A valid payment method is required to start the trial. You will not be charged during the trial period.
Subscription: After the trial, your subscription automatically renews monthly at the rate for your chosen plan. All prices are in Canadian dollars unless stated otherwise.
Launch discount: A 50% discount applies to the first 3 months for qualifying accounts. This discount is applied automatically at checkout and cannot be combined with other offers.
Cancellation: You may cancel at any time through the billing portal. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused time.
Failed payments: If a payment fails, your account will be placed in a restricted state. Service resumes when a valid payment is processed.
You agree not to use Azulyo to:
We reserve the right to suspend or terminate accounts that violate these terms without notice.
By enabling SMS automation features (reminders, review requests, win-back campaigns), you confirm that you have obtained appropriate consent from your customers to receive marketing and transactional messages from your business, as required by CASL and any other applicable laws.
Azulyo sends messages on your behalf as a service provider. You are the sender of record and are responsible for compliance with all messaging laws in your jurisdiction.
All outgoing messages include opt-out instructions. You must honour all opt-out requests promptly.
The AI phone answering system is designed to handle common barbershop booking requests accurately. However:
We recommend reviewing call transcripts regularly and maintaining a way for customers to reach a person if needed.
Our collection and use of your data is described in our Privacy Policy, which is incorporated into these terms by reference.
You retain ownership of your business data (customer records, appointment history, etc.). By using the Service, you grant us a limited licence to process that data solely to provide the Service to you.
To the maximum extent permitted by law, Azulyo's total liability to you for any claim arising from these terms or your use of the Service shall not exceed the amount you paid us in the 3 months preceding the claim.
We are not liable for indirect, incidental, consequential, or punitive damages, including lost revenue, missed appointments, or reputational damage, even if we were advised of the possibility of such damages.
We may update, modify, or discontinue features of the Service at any time. For material changes that reduce core functionality, we will provide at least 30 days' notice by email.
We may update these Terms of Service. Continued use of the Service after changes take effect constitutes acceptance.
These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of British Columbia.
